The following FAQ’s are not intended to replace qualified legal counsel and are the opinions of Agnew Bailiffs. They are presented to stimulate dialogue.

Question,

What does a bailiff do?

Answer;

The professional bailiff business goes back to the days of Robin Hood, when the sheriff was commissioned by the King and charged with collecting the rents from the tenants.

Question,

Who pays the bailiff?

Answer;

The tenant pays the costs.

However, the bailiff is the landlord’s agent and collects under the terms of the “RENT DISTRESS ACT”, which allows that the tenant will pay the costs of collection, however, if there are no assets to seize and sell or the assets are not sufficient to cover the bailiff cost the landlord must pay the bailiff.

Question,

When can I call the bailiff?

Answer;

Anytime the tenant is in arrears of rent.

However, Agnew Bailiffs & Financial Adjusters will often suggest the best time is when the tenant is more than one month late, i.e. on the second of June, when May’ s rent has not been received.
